Resumen
Is it possible in a criminal legal system like Costa Rica's to use the accused's silence as an evidentiary or argumentative input to substantiate their guilt? This is the question this article seeks to answer. The issue has arisen since, in ruling 57-2024 of the San José Criminal Court of Appeals Specialized in Organized Crime, the "Murray doctrine," jurisprudentially developed by the European Court of Human Rights from the 1996 judgment in the case of Murray v. United Kingdom, was applied as a relevant element to annul an acquittal handed down in a money laundering case.

Resumen
In criminal proceedings, the application of the theory of the burden of proof is discussed, considering the presumption of innocence. In the circumstances of exemption, mitigation or extinction of criminal responsibility (defences), it is debated whether they should be proven by the defense or refuted by the prosecution. This article aims to address this issue: which party must assume the burden of the proof regarding these circumstances, and which standard of the proof must be met? After an introduction to the aspects discussed, the position of Spanish doctrine and jurisprudence will be analyzed. Finally, a personal conclusion regarding the debate will be provided.

Resumen
The text analyzes information about the workers linked to the tanneries in the city of Pelotas between the 1930s and 1940s, recorded in the applications for employment contracts and in the claims asserted in the processes of the Labor Courts. In the applications referred to, personal and professional details are accessed, as well as a 3x4 photograph, while in the processes, the peculiarities of work in the tanneries are observed. Based on these documents, the profile of the workers, their working conditions, and the reasons that led them to take legal action against their employers has been verified.

Resumen
The objective of the article is to explore the dynamics established between prisoners dedicated to forced labor in public works in Buenos Aires and police authorities in the organization of said punishment. Analyzing the involvement of these agents allows us to illuminate another police task, of a punitive type, that remains to be examined by the historiography of the subject, especially in the transition from the 18th to the 19th century. We address this problem from a wide range of sources to unravel how the former regimental police tutelary matrix enabled a corrective activity on the inmates linked to work compulsion.

Resumen
This article aims to study social tourism during the Unidad Popular in Chile (1970-1973) and specifically its program of balnearios populares. It is pointed out that the balnearios populares are part of a historical development of the right to leisure and tourism, but that during the Unidad Popular, they were part of a dispute for the traditional spaces of the elite and favored middle class. As a result, it is noted that the balnearios populares spread throughout the country, impacting the lives of thousands of tourists and playing an important role in constructing a socialist society.

La reciente aportación de Paul a la colección Elements in Historical Theory and Practice, editada por Daniel Woolf para el sello editorial de Cambridge University Press, presenta un viraje tan interesante como sugerente. Historians’ Virtues. From Antiquity to the Twenty-First Century no hace objeto de su análisis los procedimientos internos y externos de la interpretación histórica, que parte de na determinada hipótesis y sigue con una serie de inferencias deducidas de las fuentes y sujeta a falsación. Tampoco tematiza los acuerdos epistemológicos, tácitos o explícitos, instituidos entre los historiadores y las audiencias. Lo que la lectora y el lector hallarán a lo largo de este libro es una novedosa disertación sobre la categoría de “virtud” en la historia de la historiografía.

Resumen
During the first decades of the 20th century, practices raised around the patriotic festivities in the National Territory of Río Negro helped to set up spaces where positions were re-negotiated in the social and political framework of the community. In this sense, the goal of this paper is to warn how women, essentially belonging to local elites, adopted strategies through different channels of active participation, enabling experiences of appropriation in the public sphere, as well as demonstrating their skills to a progressive, although late, incorporation into effective citizenship.

Resumen
After the Spanish Civil War, the Church launched a project of re-Christianisation through which it sought to re-establish the unanimity of society around Catholicism. The interior missions, the spiritual exercises, and the Lenten conferences were three of the most important instruments used by the clergy to achieve this goal. Through these instruments, the Church demonstrated its attachment to traditional forms of religious communication and a rigorist conception of religiosity. At the same time, all three adapted to apostolic actions specifically aimed at the working class.

Resumen
In 1622, when Gregory XV founded Propaganda Fide, there were seven dioceses in Asia under the royal patronage of Portugal. All of them had bishops, with the exception of Goa, whose Archbishop had died months before the bull Inscrutabili Divinae Providentiae arcano was issued, which canonically instituted the new Roman congregation. This article offers a macronalytic approach to the affairs of the dioceses of the Portuguese patronage in Asia. The problem that will be addressed is whether the papal decision to create a dicastery to evangelise the world was justified by a lack of commitment from the Portuguese episcopate in Asia.
